The Kauffman Foundation has a report out ranking the "new economy" states. Their methodology "measures the extent to which state economies are knowledge-based, globalized, entrepreneurial, IT-driven and innovation-based � in other words, to what degree state economies� structures and operations match the ideal structure of the New Economy." The winners? Massachusetts, Washington, Maryland, New Jersey and Connecticut. The laggards? Mississippi, West Virginia, Arkansas, Alabama and Wyoming.
I never really know what to make of reports like this, but one of the metrics is "immigration of knowledge workers," which really isn't under the control of individual states. Visa quotas are set by the federal government. But why? There are a lot of places where a national solution really is best, but that seems particularly untrue in immigration. Detroit, for instance, has a lot of empty houses, a lot of shuttered factories, and a lot of emigration. They could probably use a bunch of immigrants to occupy homes, buy things, and start businesses. Similarly, California has had a pretty good experience with letting highly skilled immigrants start tech firms in the Northern part of the state. Maybe they'd like to let even more of them in to do it. These graphs explain the potential appeal (click for a larger version):

There are obvious difficulties with having a California visa that doesn't work in Oregon. But we have limited visas now -- think student visas, or temporary agricultural workers -- and we seem to get by all right. Another concern would be that certain states would be overtaken by xenophobia and basically shut off immigration, though Arizona suggests that you can do quite a lot to make immigrants miserable even without changing the number of available visas, and my hunch is that any state that went too far in this direction would face a tremendous outcry from its business community.

Here is my understanding --
If the sister company uses a different Fed Tax ID (i.e. is an independent company legally), they can file your GC in EB2 using your experience in previous company.
I did not face this situation but somewhat similar. Our company was acquired by another holding company but we are maintaining our Tax ID. The Attorney said that my H1 as well as GC process remains valid since we are being treated as a independent company legally.

forgot to attach my previous employer experience letter
Same happened to me, I waited for RFE and send the experience letters when received RFE, but this can potentially increase your processing time.
Once you receive the receipt number, you could send the copy of experience letters if you are concerned about the processing time, (but that doesn't guarantee that you may not be issued RFE)

Shouldn't be difficult but it is the USCIS that we are talking about after all. Unless it is passed as law, it wont happen. A dual stage I-485 application process was being discussed last year but nothing came out of it. Piecemeal legislations will not pass as the public wants CIR not bandaids.
And FYI, EAD does not eliminate employer dependency—you still need an employer.

Please remember here that earlier employer could use ur I140 for other employees but that rule was also changed in 2008. I140 once approved, you keep I140.
Revoking I140 is not good for employee as it is his application to USCIS in this process and will put him in problem for other employees sponsorship.
Chances are remote.

Hello All,
If my priority date is current as of November bulletin, do I have time
until 30th November to mail the I-485 application?
Or does the DOS need to have received the application on or before 30th November?
And if I am in California, where does the I-485 application physically go?
[Its a long story why I didn't when the doors were open in July-Aug]

there are many threads on the same topic. it is an error by them when they send a document which can not be classified in anything else in those categories. may be some inexperienced employee is updating it.

Hello All,
My company filed for my H1-B extension and I have already received the Notice Of Action (Receipt) with "Received date: October 21, 2008" and "Notice Date: October 24, 2008." My case is in Vermont Center. However when I do the case search on USCIS.gov site, it says:
"Your case can not be found at this time in Case Status Online. Please check your receipt number and try again. If you need further assistance, you can either call the National Customer Service Center at 1.800.375.5283, or you can send an e-mail to uscis.webmaster@dhs.gov."
I did not type my EAC number incorrectly. I did try to call the above number, which happens to be the national center's number. However it goes in loops and loops but I was not able to speak to a Customer Service representative...I tried almost all applicable options.
Is there a way i can call the Vermont Service directly. If so could anyone please list that number. I would really appreciate any kind of help and suggestions regarding this.

I just got my Labor approved a couple week ago and now i want to file I-140 premium processing. But my lawyer's not allow me to do that coz once my I-140 approve i can't file my 8 th year extension. My 7th years H1B will expire on Aug 30, 2007.
I'm very confused now, on my understanding once i get my I-140 approve, i'm eligible to get my H1B 3 years extension.
FYI: i chose CP opotion, is that make me not eligible to get my H1B extension once my I-140 approve?

I filed my 485 in Aug 2007 (in the July fiasco), but filed my EAD in Jan 2008. So do I need to send the application fee.

Yes there is. You need to write to the Service Center that has your I-485 and ask that the approved I-140 with the earlier priority date be substituted for the one in your 485 file.

Hi,
I lost my jon w/big software consultancy. I found another project and then applied for H1-B transfer with Indian consulting company. Its been almost 1 month since new company have filed for H1-B transfer and renewal (my H1-B was expring on July 6th, 2009).
so far, i've not received any H1-B recipt. I'm worried about it. I'm also getting married in the last w/e of Nov, 2009. Is it a good idea to file for Premimum processing.

First, your attorney needs to call USCIS and ask if they received your application and get a receipt number. Then, you can file a form I-907 to upgrade it to premium processing. Moreover, you cannot start working for a company until you get a receipt notice, so this could cause issues to you incase you already started working. Have your attorney contact USCIS asap and track where your application packet is.
