Before i begin let me say its my mistake :(
My EAD expires Oct 08 and my lawyer sent me the forms to file in and send it back to him to be filed in Aug 08. But it was delayed by me till last week and was filed yesterday. what are my chances of getting EAD and continue working. In June 08 i went to India and came back using AP so i am not in H1 (i assume).
what should i do if i dont get EAD approved before oct 08?

My wife got a job offer on contract basis for 3 months. I am on h1 and she is on h4 so far. I am planning to stay on h1 itself. If my wife accepts this job using EAD, Does my status also changes? Is it okay if she dont find a job after this contract expires, what status she will be in during that time, h4 or EAD?

While I laugh at that guy. I would like to remind you that we are living in a republic and not in a democracy.
Any one can be a self hurting fool using his/her "Individual�s God-given, unalienable rights". While in a democracy individuals worry about majority rule and popular thought.
I dont understand why Obama (a former senior lecturer in constitutional law ) refers to this country as democracy.

Just fyi to be cautious.
There was a CBP Admission Review Squad at Washinton Dulles Airport on 11th evening. They sent all passengers from multiple flights to secondary check where they had to wait for over 4 hours. They were instances were people were not admitted or given just 1 month entry with specific instructions written on I94 that they cannot apply for EOS or AOS. This is for visiting Visa.

The Conrad 30 J1 waiver program has been extended to September 09.

Hi,
My U.S. born son is travelling with my friends from India to USA. He had gone to India for summer vacation. Would anybody have any sample letter for addressing to immigration authorities that we authorize his travel along with my friend.

US born child is citizen by birth and has RIGHT to enter United States. Immigration officials cant deny him the right to enter USA.
A simple letter saying that you have authorised your friend to accompany your child (minor) for the travel. The letter should have your contact address, cell etc

USCIS is all about balancing work...they are being forced to accept butt-load of AOS application, and they shift the balance this way....
Also they will take months or even years to send back receipts EADs etc...wait n watch....we made them swallow the tought pill, and they will make the same pill stuck in our throat for eternity now.....

Hi,
My company prepared for my PERM filing in EB2 category. They did all recruitement efforts. But at the time of filing, company annouced some lay-offs as "restructuring". Now my lawyer says, it is their policy not to file for PERM before six months of any lay -offs since some lay -offs involve same job title as my labor supposed to be filed. Since this is my lawyer's policy, My question is, is it safe to file PERM right now? What if I use different job title then the one my lawyer used before for recruitement efforts. (I understand he has to do new recruitement efforts for this ne job title, but is it safe?). What choices do I have, I do not want to delay my PERM filing. Please help...

I have probably a strange case .In 2007 when all the dates were current my employer filed I-140 & I485 at the same time in EB2 . I have received AP and EAD both according to standard procedure.I have maintained my H1B status. Then after a month or so I have received I-140 rejection due to different job requirement and I am overqualified for the job so my attorney interfiled new I-140 under EB3 without worrying about I 485 thinking since I 140 is denied it should nullify I485 under EB2 . In the mean time USCIS sent me a new I-485 receipt # . I got my I 140 approved in another six months under EB3 and now I have two I 485 receipt numbers as well as two A numbers. Both of the receipts when I checked the status show that it is under initial review. Shall I call USCIS and get rid of the initial I485 which is under EBII . Anyone had this kind of experience??

You can apply for multiple H1B at the same time. No need to pay Company but they will aks you to join once H1B gets approved. so at that point you need to decide which one is better for you. You can work for both of them if one of them is ready to offer you part time work. Please Get attorney advice on that part.
