Here is s tricky situation :
8th Year H1 extension applied by current company. Still in process, should be approved in Nov 2006.
Can I transfer to a new company using this H1 ?
There is nothing tricky, it is plain and simple: you want to switch jobs?
You have to apply for a new H1. You absolutely cannot use your current H1 to work any other job.

I got a family based green card (through my father - F1 family based category).
My father lives in east coast.
When I entered US on immigrant visa at that time my father was in India for one month visit.
Before my father come to US I moved westcoast for Job.
So basically after getting GC I have not stayed with my father even for a single day.
Now I am planning to go to east cost to visit my father and from there we are planning to visit canada.
My questions:
1. Is there any requirement that after entering on immigrant visa(GC) I have to stay with my father (even for few days)?
2. For my Canada visit: What things I need to keep with me (except GC and Passport) while entering US (from canada)?

My h1 is valid till march 2010.. but the i-94 i have is expiring in Oct.. (i changed my job ..and had been out of US..on the old stamping..)
Can iget it extended staying in US? or do i have to leave get it restamped in desh.. ?
Is it illegal to stay on expired i-94..but witha valid H1?????????
The timing of when you travelled and when your extension was approved are critical. It looks like you travelled after the extension was approved, but you just used the old visa to enter. CIS has a "last action" rule, whereby the last thing they do regarding your status is what governs. If you got an I-94 to October 2009, after the extension to 3/10 was approved, then the 10/09 date governs and you need to file an extension. Alternatively, you could travel and return showing the valid visa and new approval to get the new approval date on the I-94.

Th I-140 is not revoked yet, but the original company that filed it is going to split in to 2 separate companies by the end of the year and I think I-140 will become invalid after that right if the original company doesnt exist anymore??
You can still claim the PD of your old I-140. Once an I-140 is approved PD is yours to keep for life.

So what if DOL doesn't respond before the H1 expires..Can the Employer file for H1 Extension without an approved LCA ??

The employer needs to submit proof of the EIN to DOL, wait for DOL to confirm, then file a new LCA. DOL will tell the employer what EIN evidence it needs to present.

Agree on the eye, it's important to see that, and have a little catchlight for making the animal look alive. Only problem with the first shot is the branch behind the head. It's blurred a bit which helps though. The background is difficult to control - you take what you get many times with animals and birds.

Wondering if a little something when filing my taxes will backfire on me when filing I-140/485.
I'm single/no dependents but for past 4 yrs or so when filing taxes have showed 2 dependents for child tax credit (no earned income credit applied for)....my niece/nephew. My bro had full knowledge and he had suggested as due to his status in US, he is not required to file taxes. Sis in law not working, so not filing taxes. So i used to do that....
It won't come to bite me right???? ok i am never doing this from now on but is it too late for me. Obviously on my immigation forms i will show no dependents etc as i have none...
any advice.....
Personally, I wouldn't send my tax returns until I have spoken to a GOOD lawyer. There are quite a few IO that do not ask for tax returns b4 or during the interview. However, it shouldn't be a problem as you can explain it away. Simply - they were my dependents in those 4 years !! But now they are not, simple.

For past few months I hear some noice on the web that USCIS may be changing its policy soon by discontinuing Concurrent filing and allowing people to file I485 If I140 is approved irrespetive of visa number availability. How far this is true, have any body got more details on this ?? :confused:
there was a proposal a while ago to stop allowing concurrent filing, but I have only heard about filing of 485 without an I-140 from people who wish for that, nothing from USCIS.
Something like that requires a change in the law, its not a matter of USCIS policy

Before walking to the consulate, it is important that applicants leave their cell phones and any other electronic devices in their cars. After checking that all electronic devices and other prohibited items are left in the car, the applicants will enter the building and go through security. After going through security, they will be issued numbered tickets. All U.S. citizens should be prepared to present their passports (or passport cards if traveling by land) beginning June 1, 2009. Requiring experience in addition to MS degree is considered "normal" for positions in Job Zone V. Whether it's more likely to trigger an audit or not - I doubt anybody will be able to tell you. For that somebody has to have experience of filing two PERMS, almost identical except for the experience requirement. I doubt many people have such an experience
