I am in the same situation . The responses from the lawyer are Incorrect .I spoke to my companies attorney and they advised me to apply the H4 extension in Premium and then go with the new H1 in regular so that your H4 ext will be approved first and able to maintain the status until Oct 07

Hi,
I went to US on B1 and came back to india last week, I would like to apply H1 in the current year. Is there any cooling period to apply H1B once come back from US on B1 or Can I start the H1B process immediately.

You must be actually in H-1B status in order to use the H-1B portability provisions. This is what allows you to start with Company B once their H-1B petition is filed, rather than wait until the petition is approved. To use this, you need to get into H-1B status for Company A 9either through a COS petition or by entering the US in H-1B status. I don't recommend that latter option if you know that you will be changing employers as soon as you enter the US.
Alternatively, you could change from Co. A L-1 to Co. B H-1B, but you cannot start working for Co. B till the COS is approved.

Returning to the US after living abroad for 9 years and need to know what is the best process for my wife to re-apply for green card.
History:
My wife and I have been married for 20 years, own a home in the US and have one child who holds a US passport. While living in the US my wife held a Green Card. However, when we moved she surrendered the card. Now we are returning to the US and she need to get the Green Card once again. Does she need to apply as if this is the first time or is there an application or process for previous residents or Green Card holders?

JakeJake, am not sure but have heard from some previous GC holders that once you surrender then it is very difficult to get it back. She might have to start all over again. Have u checked with any attorney regarding this?

After you applied your 485 and work for the same company for 180 days, also you got your EAD. .....
Can someone change the employer afterwords (after 180 days) without worrying about H1B visa renewal/transfer?
If so what are the requirements....common guru's give us some hopes....

I work in a semiconductor company and got laid off last week. My company informed me that they will inform INS to cancel my H1B in May. I plan to go back to school and change my status to F1. My question is, to do a change of status from H1 to F1, will they ask my recent pay stubs? Please reply

Spouse 485/AP/EAD applied August 2008 (received receipt notices)

Till date I have not received my FP notice. I applied for my EAD (even though I am not planning on using it) hoping to jump start my pending 485 and get the things rolling for FP and processing of 485. Surprisingly, I got my EAD approval email on Aug 17th and I received my EAD card in the mail yesterday. It is valid for 2 years. It says finger prints not available. No change in the pending 485 status.
I am totally perplexed about receiving the EAD without FP and so is my attorney. Can someone give me an idea of what is going on? Any input is appreciated! Thanks much!

Wow ! I am in exactly same situation. I talked to national service center and they said they will talk to only employer or attorney. I told attorney about it and they said, dont worry , there online status system is screwed up so just wait for decision snail mail.
After seeing your mail, I am susoecting VSC cases are having issues with status search. so I would say that dont worry.

I am a physician with subspeciality board certification. I have been in AOS/EAD since July 2008 as a dependent on my wifes EB3 Employment based petition.
Due to current retrogression, I want to explore the EB1 route. The question I have is can I apply for a new EB1/AOS in view of my current status of being in AOS/EAD already.
Yes, you can. This will be an independent petition, and will have no effect on the existing I-485 (at least, in principle - the USCIS may get confused if they see two petitions, and issue RFE, denial, etc., in which case you need to reply back to them with proper evidence, etc.).

You don't have to leave the country if your change of status to H1 is approved with a new I-94 attached to it. However, if they approve COS without providing new I-94 then you need to immediately leave the country and re-enter with a new visa stamp.

Please remember here that earlier employer could use ur I140 for other employees but that rule was also changed in 2008. I140 once approved, you keep I140.
Revoking I140 is not good for employee as it is his application to USCIS in this process and will put him in problem for other employees sponsorship.
Chances are remote.

This law only applies to H1-B filing fees paid to USCIS. Your employer is still legally allowed to collect any attorney fees for filing your petition from you.

Had my appointment on Sept 8 at 10am, wife was also with me for her H4 stamp. Went for fingerprinting, then went to 20th floor for interview.
This was the interesting part! The Visa officer asked where I worked, then asked me where I was from. I said Lahore, he then started asking me about situation there with respect to the floods, and whether our families were affected etc. He then said, everything looks good and told us to come back on the 10th (2 days later) to collect passports. He did not check a single document (job letter, paystubs etc.). Just asked me about Lahore and sent us on our way.
Considering I am Pakistani, I thought this should give hope to other Pakistanis applying. Btw my first name is not so rare, but last name very rare. Also work for a Fortune 100 firm.

Yes there is. You need to write to the Service Center that has your I-485 and ask that the approved I-140 with the earlier priority date be substituted for the one in your 485 file.
